NOTE: Change in Minor Injury Regulations as of June 2009 – Certified Examiners

When there is uncertainty or disagreement between a claimant and defendant under Alberta’s Minor Injury Regulation, Certified Examiners give opinions as to whether an injury resulting from a motor vehicle collision is minor or not.

The Alberta Court of Appeal recently ruled that the Minor Injury Regulation under Alberta’s Insurance Act does not infringe on Sections 7 or 15 of the Canadian Charter of Rights and Freedoms. Consequently, the cap on pain and suffering awards for sprains, strains and whiplash associated disorders (grade I and II) from automobile collisions is again in force and Certified Examiners can expect increasing requests for their services.

All registered Certified Examiners must ensure that their contact information is up-to-date. Changes must be submitted in writing to the College at:

Important reminder to Certified Examiners: 

  • Reasonable efforts must be made by a Certified Examiner to schedule an assessment within 30 days of referral. 
  • The claimant must be provided with written notice of the time, date and location for the assessment.
